Rent in Advance Rules from May 2026: What Landlords Need to Know

What's changing with rent in advance?
From May 2026, there are clearer limits on what landlords can request upfront.
In simple terms:
- Rent cannot be requested before a tenancy agreement is signed
- Once agreed, rent in advance is limited to one month (or 28 days)
- Requesting multiple months upfront is no longer allowed
- Tenants can offer to pay more voluntarily, but this cannot be encouraged or required
This marks a shift towards a more standardised and transparent approach to payments.
Why this matters for landlords
These changes are designed to create a fairer system, but they also mean landlords need to be more structured in how they handle the start of a tenancy.
It's now important to:
- Keep communication clear and consistent
- Avoid informal or unclear payment discussions
- Make sure all figures and expectations are aligned
- Keep proper records of what has been agreed
Small inconsistencies can create confusion, so having a clear process is key.
Important note for upcoming tenancies
We're aware that many landlords — particularly those with student properties — already have tenancies agreed for start dates after May 2026, often using the current rent in advance structure.
For all South Beach Lettings managed clients, we will be:
- Reviewing any tenancies starting after 1 May 2026
- Issuing revised tenancy agreements where required
- Ensuring all documentation is updated in line with the new government guidelines
This means our landlords do not need to worry about reworking agreements or contacting tenants directly — we will handle this as part of our management process.
Handling holding deposits correctly
The holding deposit stage is where things can sometimes become unclear if not managed properly.
Under the new framework:
- Holding deposits must remain separate from rent
- They should not be used as a way to secure additional upfront payments
- The process should be clearly explained to the tenant
- Records should be kept showing what was agreed and when
At this stage, the focus should stay on progressing the application — not negotiating payment structures.
Setting expectations before move-in
Once a tenancy is agreed, clarity becomes even more important.
Before move-in, tenants should clearly understand:
- What they are required to pay
- When payments are due
- How rent will be paid going forward
Everything discussed at this stage should match the tenancy agreement, any previous communication, and the agreed rental terms. Introducing new expectations late in the process is something to avoid.
What a well-structured move-in looks like
A smooth start to a tenancy usually comes down to good organisation.
We always recommend making sure tenants receive clear written information covering:
- The agreed rent amount
- The payment schedule
- Confirmation of any payments already made
- Instructions on how to make future payments
- All relevant tenancy documentation
This not only helps tenants feel confident but also protects landlords if questions arise later.
Common mistakes to avoid
With the new rules in place, there are a few areas landlords should be careful with.
These include:
- Requesting rent before the tenancy is formally agreed
- Asking for more than one month's rent upfront
- Using outdated tenancy clauses that refer to multiple months in advance
- Making informal comments that could be interpreted as encouraging higher upfront payments
A consistent and professional approach helps avoid these issues entirely.
